This

matter is so very clear in the court’s mind at this time that I see no very substantial reason for postponing the giving of my opinion to counsel, nor for the delay and-trouble incident to the preparation of a more detailed opinion in the ease. What I am saying now is being taken down, and it will be sufficient for the needs of the government in prosecuting appeal or error proceedings, and what the government really cares for is not the opinion of the District Court, but the opinion of the Circuit Court of Appeals and possibly of the Supreme Court.
