Defendant was convicted of one count of first-degree murder, and one count of endangering safety by conduct regardless of human life. *742The judgment of conviction an,d sentence was affirmed by this court, upon defendant’s appeal, in State v. Bergenthal (1970), 47 Wis. 2d 668, 178 N. W. 2d 16.

Subsequently, defendant instituted other proceedings, including appeal of this court’s decision to the United States Supreme Court, certiorari denied, 402 U. S. 972, 91 Sup. Ct. 1657, 29 L.
