This matter is presently before this Court on the Motion of Defendant, Chenoweth-Massie Partnership (“Defendant”), for Summary Judgment, and the Cross-Motion of the Plaintiff, Marian Bronner, both individually and as Personal Representative of the Estate of Bernard H. Barnett (“Plaintiff’) also for Summary Judgment. There are no material facts in dispute. Rather, this ease turns on the narrow legal question of whether an option agreement is an executory contract that must be assumed or is otherwise deemed to be rejected under Section 365…
