This is the second appeal of this case. See (Tex. Civ. App.) 37 S.W.(2d) 105S. The Commission of Appeals reversed and remanded the case on account of misconduct of the jury. 55 S.W.(2d) 540.’ We refer to the case on appeal in the two courts for a fuller statement of the history of the case than we think necessary to make here.
