Procedural Background
On May 1, 1996, the plaintiff filed a “Motion to Remand.” This Court denied the “Motion to Remand” on July 11, 1996. During a scheduling conference held on July 19, 1996, the plaintiff informed this Court of its intent to appeal the denial of the “Motion to Remand.” The Court instructed the parties that it would issue written reasons for denying the “Motion to Remand” after a “Notice of Appeal” was filed.
