This is an appeal from the District Court of Atoka County, Oklahoma, from an order and judgment refusing to dismiss an appeal from the County Court of Atoka County, Oklahoma, and from the judgment of the District Court denying claim of H. A. Led-better for attorney’s fee.

On the 18th day of October, 1949, H. A.
