I. Introduction

This is an interlocutory appeal by Appellant City of Denton from the trial courts denial of its motion for a traditional and a no-evidence summary judgment based on the City’s assertion that governmental immunity bars the premise liability suit filed against it by Appellee Rachel Paper. 2 In three issues, the City claims that the trial court erred by denying its motion for summary judgment because the defect at issue was not, as a matter of law, a special defect; because the City conclusively proved that it had no actual knowledge of the…
