ROGERS, Circuit Judge.
This is an action brought upon a policy of insurance issued by the defendant company in the amount of 898,156, on the life of Neil B. MacKelvie and payable to Jeanette L. MacKelvie, his wife. The policy is No. 849,153 and is dated August 7, 1918. Neil B. MacKelvie died on August 17, 1918, and on May 23, 1919, the plaintiff presented to defendant due proof of his death. The plaintiff is a citizen of the state of New York and a resident of the Southern district. The defendant is a corporation organized under the laws of the state of New Jersey.
