This is a discovery proceeding. No answer was filed but this does not prevent the court from passing on the title to the account in the Manufacturers and Traders Trust Company. (Matter of Akin, 248 N. Y. 202.)

John Jarmakowski died intestate on March 13, 1937, leaving him surviving his wife and four children. During the hearing in this proceeding it was discovered that there was and is an account in the name of John Jarmakowski or Agnes Jarmakowski, the latter being decedent’s sister.
