Maxwell, Ch. J.

This is an action in the nature of a creditor’s bill. The petition alleges in substance that on the 1st day of February, 1877, Smith and Crittenden, the defendants in error, commenced an action against the plaintiff in the district court of Butler county to recover the sum of $1733.31 and costs; that on the 3d day of that, month an order of attachment was duly issued in said cause and levied upon the south half of the south-east quarter of sec. 27, township 16, range 1, as the property of said Wright; that on the 3d day of December, 1878, the plaintiffs in said action recovered…
