—Appeal from a judgment of the Supreme Court (Keegan, J.), entered February 21, 2001 in Albany County, which, in a proceeding pursuant to CPLR article 78, dismissed the petition as time barred.

Petitioner, serving a sentence of I2V2 to .25 years for a conviction of robbery in the first degree, commenced this CPLR article 78 proceeding challenging a determination denying his request for parole release. Supreme Court dismissed the petition as barred by the Statute of Limitations, prompting this appeal.
