DECISION
This matter is before the Court for decision on the defendants' motions for summary judgment on plaintiff's complaint and defendants' counterclaim.
FACTS
Plaintiff, Gerard S. Kempen ("Plaintiff") was the Town Manager for the defendant, Town of Middletown (the "Town") from July, 2003 until December, 2007. Plaintiff began to have conflicts with the Town Council and its president in November, 2004.
