CHOATE, District. Judge.

On the 28th day of October, 1879, the district attorney took out a subpoena duces tecum directed to James B. Colgate, requiring him to attend on the 29th day of October, at 9 o’clock a. m., before a circuit court commissioner, named therein, to give evidence de bene esse in this cause on the part of the plaintiff, and requiring him also to have with him books and papers described as follows: “All and singular, the books, papers, writings and documents now in your custody or under your control, which show or in any manner relate to any gains, profits or income, made,…
