This case is here on report of a question by a Superior Court judge pursuant to Mass. R. Crim. P. 34 and Mass. R. A. P. 4. In March, 1986, a Hampden County grand jury indicted the defendant, James Jones, on three counts of indecent assault and battery of a child under fourteen years of age, two counts of rape of a child by force, and one count of threat to do bodily harm. The defendant allegedly sexually *340abused the three minor children, ages four, five, and ten, of the woman with whom he was living.
