Upon a charge of illegal transportation of intoxicating liquor this case originated in the Bangor Municipal Court, came to the Superior Court for Penobscot County by appeal, and was tried before a jury which returned a verdict of guilty.

*385From the record it appears that before trial in the Superior Court the presiding justice dictated the following to the stenographer: “Respondent files amended pleadings. State files demurrer.
