WERDEGAR, J.

On April 24, 1996, a Riverside County jury found defendant James Alvin Thompson guilty of first degree murder and found true the special circumstance allegation that the murder was committed while defendant was engaged in the commission or attempted commission of robbery, in violation of Penal Code section 211. (Pen. Code, §§ 187, 189, 190.2, subd. (a)(17)(A).) The jury found not true the allegation that defendant personally used a firearm. (§ 12022.5.) In a subsequent proceeding, the jury also found true the special circumstance allegation that defendant had been convicted…
