Norfolk & Western Railway Company (N & W) petitions for review of a decision and order of the Benefits Review Board affirming an order of an Administrative Law Judge (AU) that awarded benefits under the Black Lung Benefits Act, 30 U.S.C. §§ 901 et seq. (Act), to Olen R. Roberson, a retired N & W employee. Both the AU and the Board concluded that N & W qualified as a coal mine operator under the Act and that Roberson qualified as a coal miner who was entitled to benefits. We affirm..
