CONNER, Chief Justice.

Overruling all assignments that question the sufficiency of the evidence to sustain the verdict and judgment in appellee’s favor, we find, as briefly as we can state them, that the facts established by the verdict, judgment, and evidence are, that on the 24th day of November, 1897, W. J. Belcher, doing business with his brother, J. B. Belcher, a silent partner, purchased from the firm of Cobh •& Frazier about 800 stock cattle of the same general classes as specified in the several mortgages hereinafter mentioned.
