OPINION AND ORDER
MILLER, District Judge.
Plaintiff FHC Options, Inc. (FHC) is a Virginia corporation with its principal place of business in Norfolk, Virginia. Defendant Security Life Insurance Company (Security) is a Minnesota Corporation with its principal place of business in Minneapolis, Minnesota. FHC sued Security for breach of contract, misappropriation, and breach of fiduciary duty in the Circuit Court for the City of Norfolk. The Norfolk Circuit Court issued its Notice of Motion for Judgment (“NMFJ”) to Security relating to this suit on November 24, 1997. The record before this Court…
