TERRY JENNINGS, Justice.

We grant appellant’s motion for rehearing. See Tex.R.App. P. 49.3. We withdraw our August 31, 2006 opinion, substitute this opinion in its place, and vacate our August 31, 2006 judgment.

Appellant, Intereonex, Inc. doing business as Interdeanlnterconex (“Interco-nex”), challenges the trial court’s judgment entered, after a jury trial on the sole issue of damages, in favor of appellee, Nick Uga-rov, in Ugarov’s suit for breach of contract, negligence, and defamation.
