The learned counsel for the appellant claims that the allegations in the return clearly shoy that the adjourned town meeting mentioned in the relator’s petition, as well as the special town meeting therein mentioned and referred td, were not lawful town meetings, and so show that the relator, the town of Rochester, was not placed in a position to call upon the respondent to act under the provisions of said ch. 187, Laws of 1885.
