The issues here involved grow out of certáin condemnation proceedings in the recorder’s court of the city of Detroit. The city sought the property in question for use of the fire department. On the.trial the jury returned a verdict for the defendants in the sum of $86,000. The verdict was rendered on the 15th of November, 1921. On the 17th of November the city asked for an extension of time in which to file a motion for a new trial. The time was extended to November 27,1921.
