This is a suit to recover upon a life insurance contract issued upon the life of Josephine P. Banks, and payable to her father, Walter T. Banks. Josephine P. Banks, an adopted daughter, then about 19 years of age, disappeared in May, 1932, and has not been heard from since that timp. Plaintiff sued on the policy in November, 1940, alleging generally that after eight years of unexplained absence he believed the insured was dead.
