This is a petition for ,a writ of certiorari to review an order of the District Court denying the motion of the petitioner, John Latina, to assign the cause for trial and granting the respondent, Vera Burdick, seven days in which to propound interrogatories. The motion was filed to assign the cause for trial on July 3, 1973. The petitioner contends that since this action for trespass and ejectment was commenced by a complaint and summons, which was served on the respondent on May 16, 1973, the denial of his motion to assign this cause for trial was contrary to the provisions of G. L. 1956…
