On September 25, 1933, Frank Lynn was appointed successor receiver for the purpose of managing and collecting the rents of the improved real estate located at the northwest corner of Bryn Mawr and Marmora avenues, Chicago. Such appointment was made on the motion of a junior mortgagee. On February 2, 1934, plaintiff herein filed his complaint in chancery in the circuit court of Cook county for the purpose of foreclosing the first mortgage on the premises.
