I concur in so far as the majority opinion affirms the judgment against Brasher, hut am unable, for several reasons, to agree to an affirmance as to Priddy. I think the judgment against him should be reversed and rendered.
In the first place, the printed list is not a certain or definite offer to sell the lease at any price, and in my opinion is in fact and in law not an offer to sell at all. While it contains the recital, “Leases near the Burk-Waggoner well for sale by W. M. Priddy,” this is followed immediately by the qualifying statement, “All prices subject to change or withdrawal.”…
