BACKGROUND
Angel Ortiz (“Ortiz”), Ored Trujillo (“Trujillo”), Antonio Fuentes. (“Fuentes”) and Isaac Barreto (“Barreto”) are delivery workers who commenced this action against Chop’t Creative Salad Company LLC (“Chop’t”), Colin McCabe, Tony *578Shure and Nicholas Marsh, pursuant to the Fair Labor Standards Act (the “FLSA”), 29 U.S.C. §§ 201-219, and New York Labor Law (“NYLL”), Article 6, §§ 190-199a, and Article 19, §§ 650-665.
