Valentine, J.:
This was an action brought before a justice of the peace of Harvey county by Isaiah Scott, and X). F. Hively, partners as Scott & Hively, against Henry Stephens, to recover of the defendant the sum of $105.62 and interest, for an alleged commission due the plaintiffs as agents of the defendant in procuring a purchaser of a tract of laud belonging to the defendant. After judgment in the justice’s court the case was appealed to the district court, where the case was again tried before the court and a jury, and the jury rendered a general…
