The Charter School Program Act of 1995 (the Act), L. 1995, c. 426, §§ 1 to 18 (codified as amended at N.J.S.A. 18A:36A-1 to - 18), authorizes the establishment of charter schools in New Jersey. See N.J.S.A. 18A:36A-2 (finding that charter schools “can assist in promoting comprehensive educational reform” and that their establishment “is in the best interests of the students of this State”). The Act charges the Commissioner of Education (Commissioner) with the responsibility to establish a program to “provide for the approval and granting of charters to charter schools pursuant to [the Act].”…
