This suit was brought by ap-pellee against the International & Great Northern Railroad Company, and also against T. J. Freeman, receiver of said company, to recover damages alleged to have been sustained by him to his land and crops during the year 1908, occasioned by an overflow of the Brazos river, on account of the alleged negligent construction of said railway.
