RITCHIE, District Judge.

The plaintiff was a lessee of the defendant, and as such went into possession of a portion of the Bullion-Beck mine, *21described as block 8 on the 300 level, south, and referred to for tbe sake of brevity as block 8-300. His term of lease began August 14, 1903, and extended over a period of six months from that date. Under various extensions he asserts that his rights under the lease were extended to and included June 14, 1904, and he continued working under it until April 30, 1904.
