I find myself unable to concur in the opinion of the majority. There is much said in the majority opinion as to the relation between Roy E. Jones and the Loma Vista Development Company. The uncon-troverted evidence shows that Roy E. Jones was not an employee of the Loma Vista Development Company but of the William P. McNeeley Company; that the development company listed the property at 212 Sunset Road with the McNeeley Company upon a 5% commission basis and that Roy E. Jones was a salesman for the Mc-Neeley Company and received a commission of 2½% for each sale he made. Jones introduced…
