STATON, Judge.
In this consolidated appeal, the City of Gary and the Gary Police Department (City), along with Luis Deluna, Jr., appeal the trial court grant of summary judgment in favor of the defendant and third-party plaintiff Allstate Insurance Company (All state). The appellants contend that the grant of summary judgment was in error. Allstate claims that the appellants are collaterally estopped from challenging the summary judgment.
