On August 26,. 1982 Johns-Manville Corporation and twenty of its affiliates or subsidiaries (“Manville”) filed Chapter 11 petitions for reorganization in the United States Bankruptcy Court for the Southern District of New York. On November 8, 1982 the Committee of Asbestos-Related Litigants and/or Creditors (the “Committee”), comprised primarily of attorneys for personal injury claimants, moved to dismiss the proceeding on the ground that it was not brought in good faith.
