Poffenbarger Judge:

Howard Richards was fatally shot, while walking along a railroad track in Randolph county. Only one person claims to have seen the tragedy, namely, Bertha White, who saj^s she was walking with him at the time, and was, within a few minutes before the shooting, seen by others, going with him in the direction of the scene of the homicide. Martin Y. Carr was charged with the murder of Richards, convicted and sentenced to life imprisonment. Ho instructions were given or requested.
