LYONS, P.J.Ch.

The issue before the court is may a court annul a marriage after the death of one party to the marriage. The petitioner, Lillian E. Centeno, filed a verified complaint for letters of administration upon the death of Manuel Santolino, the decedent. The petitioner is the wife of Manuel Santolino.

The decedent and the petitioner first met in January 2000, when the petitioner moved into the decedent’s home as a tenant. On or about March 11, 2004, the decedent was admitted to Trinitas Hospital. During his hospitalization, he was diagnosed with lung cancer. He was released from the…
