Thfe plaintiff, Velma L Turner, sued the defendant, Home State Life Insurance Company, on a life insurance policy issued on the life of Bertie B. Turner, the mother of the plaintiff, and secured a judgment, from which the defendant has appealed.

The insurance company set. up two grounds of defense: First, it was alleged that the application for insurance contained representations that were willfully false; second, that Ihe insured was not in good health at the time the policy was delivered to her as required by the policy contract.
