On August 26, 1889, the appellant, a corporation, through its president, R. D. Hunter, entered into a contract in writing with the appellee, Thomas Lawson, the contract to relate back and take effect from June 1, 1889. By its terms, the appellant leased to the appellee, for the period of five years from June 1, 1889, “the saloon, cold storage building, and dwelling house, with four rooms and yard accommodations, covering about an acre of ground, situated in the coal-mining camp called ‘Thurber,’ in the county of Brath, State of Texas, with the appurtenances.” The sole…
