¶ 39. I agree with the majority’s finding that the Workers’ Compensation Commission did not abuse its discretion in denying Short’s Motion to Supplement the Record; however, I disagree that there was substantial evidence to support the Commission’s finding that Short had failed to prove the elements of his workers’ compensation claim. I must therefore dissent and would affirm the Court of Appeals’ decision to reverse the Circuit Court’s judgment, which affirmed the Commission’s decision.
