This cause comes before the court upon the appeal of Martin, Rochford & Durr (“Martin”) from an order by the Summit County Court of Common Pleas granting summary judgment to Lawyer’s Title Insurance Corporation (“Lawyer’s Title”).

Martin, a law firm, represented Marcia J. Jonke in a foreclosure action instituted against Jonke by Home Federal Savings Bank (“bank”). On September 18, 1990, the court granted a judgment of foreclosure in favor of bank, established bank’s lien on the property at issue, foreclosed Jonke’s equity of redemption, and ordered sale of the property.…
