Parties are referred to as in the trial court, or by name. This was a mortgage foreclosure action in which Muskogee Industrial Finance Corporation, plaintiff, sued C. P. Perkins and J. W. Kaiser, as defend ants. The petition alleged, among other things, that plaintiff held a mortgage on certain property, signed by J. W. Kaiser; that defendant C. P.
