Appellant, MaysoMcCall, a Negro man, was charged hy Information with the crime of assault with intent to rape, it being alleged that he assaulted Lorraine Tate, an 11 year old Negro-girl, on March 27, 1958, with the intent to rape her. On trial, the jury returned a verdict of guilty, and fixed appellant’s punishment at 21 years imprisonment in the state penitentiary. Judgment was accordingly entered,, and from such judgment comes this appeal.
