' OPINION

WESTERFIELD, J.

Plaintiffs, the father and mother respectively of a deceased son, bring this action under the Employers’ Liability Act for compensation for the accidental death of their said son.

From a judgment maintaining an exception óf no cause of action, plaintiffs have appealed.

It is alleged that petitioner’s son was employed at a gasoline oil filling station *135conducted by defendant and that while engaged in “blowing up” a tire for a patron of said oil station he was killed by a shot from a revolver which was accidentally discharged by’ a fellow workman.
