I respectfully concur in result. I do so believing that the State's procedural decisions at the trial court level have forfeited its appeal.2

I begin by noting that the State's right to appeal in criminal cases is limited. Simply said, the State may appeal from erimi-nal proceedings only when authorized by statute. State v.
