This action was commenced on May 15, 1959, to foreclose a mechanic’s lien and to establish and foreclose an equitable mortgage. The pertinent facts are summarized.

On September 18, 1957, the plaintiff lumber company entered into a written contract with W. H. Bedore and Georgine Bedore, his wife, Raymond Bedore and W. H. Bedore, a partnership d. b. a. Bedore Brothers, building contractors, hereafter referred to as the Bedores, whereby the parties agreed that the plaintiff would purchase Lot 15, Block “C,” Meredith-Ruff Addition to the City of…
