This action was in replevin for the possession of a wagon. In a trial to the court, without a jury, the defendant prevailed, and the plaintiff has brought the record here for review by an appropriate proceeding.
The facts are undisputed, and so far as they are necessary for an understanding of the case, are as follows: On the 18th day of November, 1893, an execution was issued by the county court upon a judgment obtained by the Wyeth Hardware Company against Yorhees & Yorhees, and the writ, two days later, was levied upon the property in controversy by J.
