At Dickens was tried and convicted of murder and sentenced to life imprisonment in the penitentiary. A motion for a new trial being overruled, he excepted.

Before arraignment the defendant filed a plea in. abatement to the indictment returned against him, and challenged the array, on the ground that the grand jury as first called consisted of twenty-three men, who were instructed by the court to retire from the court-room and elect a foreman.
