Theo Eggleston brought this suit, alleging that he was the owner of Lots 24 and 25, in Block 9, of Fairview Heights Addition to the City of Fort Worth; that plaintiff purchased said lots in 1939; that at the time of his purchase there was a water well on said lots; that plaintiff erected -on the property a windmill and supplied other equipment necessary for pumping water from the well; that the windmill and other improvements cost plaintiff a large sum of money; that plaintiff has maintained and paid the expenses of the well since the erection of the windmill; that…
