Ricardo Antonio Crews (“Crews”), an inmate held at Wallens Ridge State Prison and proceeding pro se, brings this action to vacate his conviction pursuant to 28 U.S.C. § 2254. Petitioner Crews asserts that his rights under the Fifth, Sixth and Fourteenth Amendments to the U.S. Constitution were violated because (1) petitioner was unable to test or challenge DNA evidence presented by the Commonwealth because it was previously destroyed, (2) the prosecution failed to prove his guilt beyond a reasonable doubt, and (3) petitioner was denied…
