Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Washington County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, an inmate at Great Meadow Correctional Facility in Washington County, was charged in a misbehavior report with drug possession, smuggling and violating the facility’s telephone program after an investigation revealed that he made arrangements by telephone to have drugs delivered to the facility.
